Using the facilities of The Spiral Staircase, owned and operated by PRHTCH, LLC (heretofore referred to as "THE CLUB"), involves the risk of injury to myself, my spouse, children, family, or guests, whether I or someone else causes it. Specific risks vary from one activity to another and the risks range from minor injuries to major injuries, such as catastrophic injuries including death. In consideration of my, my spouse, children, family, or guests' participation in the activities offered by THE CLUB, I understand and voluntarily agree to assume and do expressly assume any and all risks of injury or death and accept this risk and agree to the fullest extent allowed by law never to sue, and to release from liability, THE CLUB, its members, directors, officers, employees, agents, contractors, insurers, spectators, equipment suppliers, and volunteers for any injury, including, without limitation, personal, bodily, or mental injury, economic loss or any damage to myself, my spouse, children, family, or guests resulting from the negligence of THE CLUB or anyone acting on THE CLUB's behalf or anyone using the facilities whether related to specific activities or not. I further expressly agree to defend, indemnify and hold harmless THE CLUB, its members, directors, officers, employees, agents, contractors, insurers, spectators, equipment suppliers, and volunteers in the event I or any legal representative of mine files a claim arising out of my, my spouse, children, family, or guests' use of the facilities, including for any damages, attorney's fees or costs arising out of or related in any way to any such claim.

All photographs, motion pictures, recordings, and/or likenesses of myself, my spouse, children, family, or guests captured at THE CLUB's facilities (heretofore referred to as "RECORDINGS") by THE CLUB, its affiliated entities or contractors, and/or the media become the sole property of THE CLUB. THE CLUB may use and license others to use SIGNEE's name and the RECORDINGS in any manner THE CLUB wishes including, but not limited to, for communication, promotion, advertising, and marketing activities.

The foregoing assumption of risk, waiver, and indemnification provisions are intended to be as broad and inclusive as is permitted by law; if any portion thereof is held invalid, the remainder shall continue in effect. I agree and acknowledge that I have carefully read this waiver and release, and fully understand it is a release of liability.

I affirm, acknowledge and attest that my telephone number and e-mail address provided to The Spiral Staircase are accurate and were provided by me voluntarily. Subject to applicable law, I agree that The Spiral Staircase, including its agents and affiliates, may contact me at any phone number or e-mail address provided by me to The Spiral Staircase.
